ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1 – The contract stipulated between Curcio Domenico. and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Curcio Domenico. This acceptance is considered tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions and payment transcribed below.
1.2 – If the Customer is a consumer (ie a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and otherwise keep these conditions general sales, in compliance with the provisions of art. 50 and following of Legislative Decree 206/05.
1.3 – Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property caused by the non-acceptance, even partial, of an order.
PURCHASE METHOD
2.1 – The Customer can only purchase the products present in the electronic catalog of the www.risicosfizio.it website at the time of placing the order, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its characteristics but may differ in color, size and accessory products in the figure. All the information supporting the purchase (Glossary, Buying Guide, etc …) are to be understood as simple general information material, not referable to the real characteristics of a single product.
2.2 – The correct reception of the order is confirmed by Curcio Domenico. by an e-mail reply sent to the e-mail address provided by the Customer. This confirmation message will contain the Date and Time of execution of the order and an Order Number, to be used in any further communication with Curcio Domenico. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, using the customer service.
2.3 – In case of non-acceptance of the order, Curcio Domenico guarantees timely communication to the Customer.
TERMS OF PAYMENT
3.1 – Credit card: in case of purchase of goods with credit card payment method, the credit card is debited at the same time as the order is processed using the PayPal platform
3.2 – Curcio Domenico. reserves the right to request additional information from the Customer (eg landline number) or to send copies of documents proving ownership of the Card used. In the absence of the required documentation, Curcio Domenico reserves the right not to accept the order.
3.3 – At no time during the purchase process Curcio Domenico is able to know the information relating to the buyer’s credit card, transmitted via a secure connection directly to the site of the bank that manages the transaction. Curcio Domenico can keep such data only on explicit request and consent of the client: in this case Curcio Domenico. guarantees that these data are stored according to certified security standards and that they are always displayed in masked mode.
3.4 – Cash on delivery: in the case of cash on delivery, an additional fee will be applied to the total amount, clearly shown when the payment method is chosen. The payment, to be made directly to the courier, will take place at the time of delivery of the products. It is possible to pay only in cash, it is not possible to pay by check. For any reason, the customer should refuse the order, Curcio Domenico has the right to request the buyer all the costs incurred for the return of the package, storage and forwarding costs.
3.6 – Purchases through PayPal: in the cases of purchase of goods with PayPal payment methods, together with the conclusion of the online transaction, PayPal will immediately charge the amount related to the purchase made.
DELIVERY METHODS AND EXPENSES
4.1 – Curcio Domenico can accept orders only with delivery in Italian territory, San Marino and Vatican City. Delivery to the localities of Livigno, Trepalle and Campione d’Italia is excluded.
4.2 – Delivery costs, if any, are charged to the customer and are clearly stated when the order is placed. Nothing is more due to the customer than the total order.
4.3 – No responsibility can be attributed to Curcio Domenico in case of delay in the order or delivery of the order.
4.4 – The delivery of the ordered means the street level except:
– different communication from our customer service,
– what is specified in the product data sheet,
– explicit purchase of delivery to the plan, where envisaged.
At the time of delivery of the goods by the courier, the customer is required to check:
– that the number of packages delivered corresponds to what is indicated in the accompanying invoice
– that the packaging is intact, undamaged, wet or otherwise altered, even in the sealing materials (adhesive tape or straps).
Any damage to the packaging and / or the product or the mismatch in the number of packages or indications must be immediately contested, affixing RESERVE OF WRITTEN CONTROL (SPECIFYING THE REASON OF THE RESERVE, eg “laundry packaging”, “crushed packaging” , etc.) on the courier delivery test. Once the courier’s document has been signed, the Customer can not make any objection regarding the external characteristics of the goods delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, according to the procedures provided in this document.
4.5 – In case of failure to collect within 5 working days of the material in storage at the warehouses of the courier because of repeated inability to deliver to the address specified by the Customer when ordering, what ordered will be returned to the warehouses of Curcio Domenico charging all charges to the purchaser
4.6 The delivery times indicated on www.risicosfizio.it are approximate and may vary up to a maximum of 30 working days.
RIGHT OF WITHDRAWAL
5.1 – Pursuant to articles 64 and following of Legislative Decree 206/05, if the customer is a consumer (ie a physical person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form a reference of VAT number), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.

5.3 – The right of withdrawal is however subject to the following conditions:
– the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, attached software, etc …);
– the right does not apply: (i) to audiovisual products or sealed computer software (including those attached to hardware), once opened; (ii) to products made to measure or clearly personalized.
– the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc …); to limit damage to the original packaging, we recommend placing it in a second box, in all cases avoiding the affixing of labels or adhesive tapes directly on the original packaging of the product;
– the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the Customer;
– upon its arrival in the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the packaging and / or the original packaging are damaged, Curcio Domenico will deduct from the refund a percentage, in any case not higher than 10% of the same, as a contribution to the restoration costs.
5.4 – The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and / or its content), in cases in which Curcio Domenico ascertains:
– the non-diligent use of the good that has compromised its integrity, or the use of any consumables;
– lack of external packaging and / or original internal packaging;
– the absence of integral elements of the product (accessories, cables, manuals, parts, …);
– damage to the product due to causes other than transport.
In case of forfeiture of the right of withdrawal, the goods will remain at our office available to the customer for collection at your expense.
5.5 – shipping costs are retained and charged to the customer for return
GUARANTEES
All products sold by Curcio Domenico are covered by the manufacturer’s standard warranty and the 24-month warranty for conformity defects, pursuant to Legislative Decree 206/05. To use the warranty, the customer must keep the receipt of payment.
6.1 – The 24-month warranty pursuant to Legislative Decree 206/05 applies to products that present a lack of conformity, provided that the product is used correctly, respecting its intended use and as provided in the attached technical documentation. This guarantee is reserved to the private consumer (a natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference of VAT number). In case of lack of conformity, Curcio Domenico provides, without expenses for the customer, to restore the conformity of the product by repair / replacement or reduction of the price, until the contract is terminated.
6.2 – In the event that, for any reason, it is not able to provide its customer with a product under warranty (restored or replaced), Curcio Domenico. may at its discretion proceed to return the amount paid taking into account the use of the good or its replacement with a product of equal or higher characteristics, or by issuing a discount coupon of the value of the goods.
6.3 – The times of repair or possible replacement of the product depend exclusively on the policies of the manufacturer and no damage can be requested to Curcio Domenico. for any delays in carrying out repairs or replacements.
6.4 – In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ..); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided. The Customer will be given a return authorization number (RMA) which must be indicated on the outside of the package, following the instructions provided directly in the relevant authorization e-mail.
LIVRAISONS
